I. Online Shopping

1.1. We have taken great care in presenting the products on our website as accurately as possible. However, the images you see will depend on your monitor's display and colour capabilities. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise.

1.2. By submitting an order to us through our website, you represent and warrant that the payment details provided on your order are valid and correct, and that when your order is accepted and processed by us, payment will be made in full. If the Billing details for your order are the same as your Delivery address details, by placing an order on the website you confirm that you are the person referred to in the Delivery address details. Otherwise, by placing an order, you confirm that you are the person referred to in the Billing details.


II. Acceptance of your Order

2.1. Shortly after you have placed an order with us, an email will be sent to you acknowledging the exact details of your order. This email is not an order confirmation or order acceptance from La Maison du Chocolat.

2.2 All product requests are subject to being accepted by La Maison du Chocolat. La Maison du Chocolat reserves the right to turn down any order for reasons of stock insufficiency, of incomplete customer information, or for any other lawful reason. We undertake to inform you within two (2) working days following your order if we encounter any problem in fulfilling your order.

2.3. Once your order has been placed, cancellations or modifications will not be accepted.
However, in exceptional situations, we will try to honour your requests for changes. A £ 5.00 fee will be charged in the event we are able to effect your change or cancellation.
In no event can a change be made once your shipment has been accepted by the shipper.

III. Pricing Policy

3.1. All prices shown on the website are in £ Sterling and are inclusive of VAT (20 %). Prices may change and offers may be withdrawn at any time.

3.2. Shipping is from our flagship boutique in Piccadilly (London). Shipping charges, which are payable by our customers, are extra, and vary by destination. For further information, feel free to contact us.

3.3 Import duty : There is no import duty payable within European Union member states. For other countries, all taxes and customs duties which may be required are at the customer’s expense, and are payable upon delivery.

IV. Payment at time of order

4.1. All on-line purchases are subject to immediate payment using credit cards. We are unable to offer any discounted terms.

4.2. Please pay attention to detail when giving us your account information. Make sure to give us your account number and the expiration date. All information should be provided in the proper field. Please double-check it for accuracy and completeness. Otherwise we will be unable to process your request if you do not enter it in the right place. Please see our Privacy Policy Statement (below) so that you may understand how this information is treated.

4.3. All on-line purchases are calculated in Pound Sterling (£).
If your payment is made in a different currency, your final cost will depend upon the rate at which your bank card company exchanges your currency for the Pound Sterling and any additional fee charged for such exchange by your bank card company. The exchange rate may be fixed by your bank card company on a day other than the day on which you request product. Invoices are available upon your request. We recommend that you download and print this documentation for your records.

V. Product Availability

The website provides an indication only of the availability of products and services. This becomes definitive only upon confirmation of the order.

5.1. We feature products on our website that have been carefully selected for Online Shopping.

5.2. Once an item is sold out it will be taken off the website at the earliest opportunity. All items are subject to availability. If, due to unforeseen circumstances, it is necessary to substitute an item, it will be only made with the customer's prior consent.

VI. Delivery of products

6.1. Product shipping

61.1. Our sealed parcels are specially prepared by La Maison du Chocolat for shipping. They are tamper-resistant and well-suited for normal handling by our shippers.

6.1.2. THE CUSTOMER IS RESPONSIBLE FOR EVERY ASPECT OF THE NAME AND ADDRESS OF THE RECIPIENT, WHICH MUST BE ACCURATE, PRECISE AND COMPLETE (DOOR CODE, FLOOR NUMBER, TELEPHONE NUMBER ETC) in order for delivery to be carried out under normal circumstances. La Maison du Chocolat cannot be held responsible if a delivery is returned as a result of an error in the address, or if delivery is not possible to the address indicated. IF THE DELIVERY IS RETURNED, OR IS IMPOSSIBLE DUE TO MISSING INFORMATION OR AN ERROR IN THE ADDRESS, ALL REDELIVERY COSTS WILL BE CHARGED TO THE CUSTOMER.

6.1.3 After we confirm your request, we will tender it to the shipping services we of our choice with delivery instructions to your designated delivery location. All reasonable efforts will be made to assure prompt delivery of your order. Although we can assure delivery to the proper location, it is up to you to verify receipt with the delivery service. Failure to identify properly to the shipper problems upon delivery may result in your inability to pursue a claim. Most of our shippers require a signature upon delivery. Once the product is delivered, we cannot be responsible if it is lost or damaged from the environmental conditions in which it is left or that develop after its delivery.

6.1.4. The Logistics Centre for the preparation and shipping of the orders is at the following address:
La Maison du Chocolat, 46 Piccadilly, London W1J 0DS.

All orders shipped to the countries listed below (6.2.1.) will be prepared and shipped from this centre.

The orders delivered to other countries in Europe are shipped from our workshop in Nanterre (France), the orders delivered to the United-States are shipped from our New York boutique and the orders delivered to Japan from our Tokyo boutique. You have to select these countries in the Home Page to have access to the current products and prices of these boutiques.

6.1.5 WHERE THE RECIPIENT OR ANOTHER PERSON ABLE TO TAKE DELIVERY OF THE PRODUCTS IS ABSENT, THE DELIVERY SERVICE WILL LEAVE A CARD TO ADVISE OF A MISSED DELIVERY at the delivery address indicated by the customer, inviting him/her to collect the products. In no circumstances will La Maison du Chocolat be held reponsible for any possible deterioration in the products caused by late collection from the delivery company.

6.2. Shipping time

6.2.1. Delivery times depend on the country of destination.
London - Same day or 1 day delivery
United Kingdom (England, Wales, Scotland, Northen Ireland) 1 day
• Guernsey – 1 day
• Jersey -1 day
• Oakney and Shetland Islands – 1 to 3 days
Ireland – 2 to 3 days

6.2.2. Deliveries are made Tuesdays to Friday (excluding bank holidays).
In London, deliveries are made Monday through Friday.

ORDERS RECEIVED AFTER 3PM GMT WILL BE PROCESSED AND SHIPPED THE NEXT BUSINESS DAY.

6.2.3. La Maison du Chocolat will not be responsible for delays caused by events beyond its control, including strikes, natural disasters, or terrorism.

SHIPPING MAY TAKE LONGER DURING BUSY HOLIDAY SEASONS (CHRISTMAS, VALENTINE'S DAY, AND EASTER).

To assure the quality of our chocolates we offer overnight or two to three days deliveries.

VII. Transfer of ownership ; Transfer of risk.

 

- Transfer of ownership of the products into the customer’s possession takes effect only once the price has been paid in full by the customer.

- La Maison du Chocolat insures against all risks of loss or deterioration of the products until the products are delivered to the recipient. Risks are transferred therefore from the time that the recipient takes delivery of the products.

 

VIII. Complaints

8.1. La Maison du Chocolat prides itself on its high level of products and its service. If you have a criticism or a complaint, please contact us at once. We will work hard to make you happy, but need your help in order to do so. Customers receiving a parcel from us should inspect it upon receipt to make sure it is consistent with the order and that there are no obvious flaws. Damage claims should be clearly recorded, dated and signed on the delivery invoice.

8.2. All claims must be made within 48 hours of product delivery. Claims received by La Maison du Chocolat after longer delays may not be honoured. Claims should be sent to our Customer Service Department, by email or by postal service offering proof of delivery of the parcel to La Maison du Chocolat. The address for claims is as follows:

8.3. All claims must be motivated and accompanied by an explanation of the problem, as well as the damages occasioned thereby. After an analysis of the situation, MDC at its own discretion will determine the appropriate remedy, including a refund of payment or a reshipment of product.

8.4. LA MAISON DU CHOCOLAT SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OF CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMIT, LOSS OF PROFITS, REVENUE OR OTHER BENEFITS ARIASING FROM OR RELATED TO A BREACH OF THIS AGREEMENT, OR FOR CLAIMS AGAINST YOU BY ANY THIRD PARTY.

IX. Returns

9.1. Returns will be accepted by La Maison du Chocolat only upon its prior express formal agreement and in no case more than 48 hours after delivery to a recipient.

9.2. Where La Maison du Chocolat accepts a return in the case of an obvious flaw or the nonconformity of the products delivered with an order, La Maison du Chocolat will allow the free replacement of the product or the return of the amount paid by the consumer. By accepting such, the consumer and any other party involved therewith (including the purchaser, where the consumer has received the La Maison du Chocolat product as a gift), agrees to waive any additional claims it may have, including for interest and other payments.

 

X. Right of access and correction

10.1. Our Privacy Policy Statement

Because of our concern with the protection of your private life and information personal to you, La Maison du Chocolat treats with the strictest confidentiality all personal information it receives about you. In connection with your purchases, we will request from you only the information (including name and street and email addresses) necessary to fill and follow-up with your order. Information you give online goes to a secure server and is immediately encrypted.

10.2. Your rights

Consistent with French Information and Liberty Law dated 6 Jan 1978, you have the right of access to the information you have provided on our website.
You also are encouraged to tell us how we can keep you up-to-date with our product line, especially seasonal specials. We would be happy to communicate with you, and to have you communicate with us, by mail, email or telephone.

XI. Warranty

10.1. La Maison du Chocolat guarantees the quality and freshness of its products for three weeks from the time they leave our boutique in London, so long as they are handled and stored as recommended by the materials that accompany each shipment.

10.2. EXCEPT AS SET FORTH IN THIS SECTION, MDC MAKES NO EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES WITH REGARD TO ITS PRODUCTS, INCLUDING ANY WARRANTIES AS TO THE FITNESS OF ITS PRODUCTS FOR A PARTICULAR PURPOSE. ANY SUCH ADDITIONAL WARRANTIES HEREBY ARE DISCLAIMED.

XII. No Resale

When you order product from us, if you are a consumer, you agree that it is for personal use (by you or other individual(s)) and that it will not be resold by you.
